Payments: An advance payment of $1100 per person will be required for all bookings. We accept all major credit/ debit cards and also PayPal. All pricesare quoted as cash discount prices and there is a surcharge for payments, after the initial deposit, made by credit card and PayPal. We accept personal as well as bank cheques and bank transfers. Domestic Air Travel supplements for travel within India (& other countries on your tour) are usually due within two to four weeks of the initial deposit. Most international flight reservations can be done by credit card without a surcharge.
50% of the cost of your tour (after subtracting your initial deposit) is required at least 90 days prior to the start of your tour, or if between 60 and 90 days remain, at the time of approval of your "Confirmation of Tour Package". The other 50% is due at least sixty days prior to the start of your tour. Reservations made with less than 60 days remaining will require immediate payment of all dues.
Reservations that include a hotel stay during the period from
15th Dec to 04th Jan & during the two weeks of the Pushkar Festival, total cost of your tour would be required to be paid at least three months prior due stringent cancellation policies of hotels/ airlines for this period.
All rates quoted are per person, based on double occupancy, and in US dollars. If not listed, single supplements are available upon request in the 'Comments" section in each 'Reservation Inquiry Form'. All prices, except for when a deposit has been accepted by us on a C.O.T.P. submitted to the guest, are subject to change at any time at the sole discretion of our company.
$150.00 of the initial deposit is non-refundable regardless of when you choose to cancel, and may not be applied towards changes in your itinerary. It goes to pay our initial costs, such as mailing costs, costs associated with making your initial reservation, and associated administrative costs. Airline tickets (purchased by company on your behalf for travel within India/ its neighbouring countries) cancellations will incur charges as levied by the airline. Restricted fares will have higher costs while unrestricted fares have generally a token charge of $10 to $20 per segment.
Cancellations: If we don’t receive or are unable to process any of your payments within as per the schedule outlined above, we will cancel your reservation and process a refund of your total payments, after adjusting for the agreed upon Cancellation Costs. A request for cancellation will only be considered valid if it is processed as follows:-
(a) Received by our web site submitted on the appropriate form (link provided as part of the C.O.T.P. at the time of initial confirmation of your order).
(b) By registered mail or delivery service (with proof of in- person delivery) at our official mailing address -
Within two to three business daysof receiving your request for cancellation we will send you a link to your Cancellation Agreement which details the exact amount refundable to you, if any, as per your original contract (COTP). Once we receive your acceptance of this agreement, we will process your refund promptly.
For tour charge payments made to the company, and only for those payments, the following cancellation terms and charges apply:
Cancellation Costs:
(a) Cancellations received by us minimum three months (but after four months) prior to commencement of journey will levy cancellation charges US $250.00 per person/ 5% of the total cost of your visit (whichever is higher). Airline tickets (purchased by the company for travel within Southeast Asia) cancellations will incur charges as levied by the airline. Restricted fares will have higher costs while unrestricted fares generally have a token charge of $10 to $20 per segment.
(b) Cancellations received by us between three months and Sixty days prior to your visit begins, are charged US $500 per person/ 15% of the total cost of your visit (whichever is higher). Reservations that include a hotel during the period between Dec 15th and Jan 04th & during the two weeks of the Pushkar Festival, 75% of your total costs are charged upon cancellation.
(c) Cancellations received between sixty days and
thirty-five days remaining till your visit begins, are charged $1000 per person/ 35% of the total cost of your visit (whichever is higher). Reservations that include a hotel stay during the period between Dec 15th and Jan 04th & during the two weeks of the Pushkar Festival, 90% of your total costs are charged upon cancellation.
(d) Cancellations received between thirty-five days and seven days prior to your visit begins, are charged of $1500.00 per person/ 75% of the total cost of your visit (whichever is higher). Reservations that include a hotel stay during the period between Dec 15th and Jan 04th & during the two weeks of the Pushkar Festival, 100% of your total costs are charged upon cancellation.
(e) If less than 7 days remain, a cancellation is considered a "no show"* and does not qualify for a refund.
Please note that certain airfares cannot be cancelled. Domestic airfare purchased by the company on your behalf as a part of your tour will be subject to the following Cancellation & Change terms: Prior to 7 Business Days before the beginning of your tour you will incur charges as levied by the airline + a $10 Service Fee per segment. Unrestricted (Full) Fares usually have a token charge of $5 to $10 per segment while Smart Fares will have higher costs. If less than 7 Business Days remain till the beginning of your tour all domestic fares are non-refundable & cannot be changed.
Changesto your tour package after your acceptance of the "Confirmation of Tour Package" are done at the sole discretion of Taj Mahal India Tours & Travels. There is a minimum charge of $50 per change to your itinerary, if we are willing and able to make the change. This amount can and will be higher depending on the complexity of your request and the amount of effort required by our staff. This charge does not include the costs of the change itself.
Force Majeure:Any changes which might be required to your itinerary as a result of Force Majeure or other similar reasons that are beyond our control, such as weather conditions, strikes or riots, overbookings or closure of a hotel, decisions taken by Tourist Organizations and/or State Governments, etc would be advised to you at the earliest possible date. This may result in an alteration of the itinerary, omission of a destination, or changing the time spent in a particular destination. If it is possible we will provide you with alternative arrangements, and if not, give you a refund as per our stated policies. We cannot be held responsible for losses (in any sense of the term) resulting from airline or train delays or cancellations, whether domestic or international. Nor are we responsible for losses due to a guest's decision to change their itinerary, even if it is due to their inability to do so. Travel Insurance is offered to offset such situations. Although we will do our best to minimize additional guest expenses (and provide all extra services that are directly conducted by our staff at no charge) in such a situation, any additional costs (for hotels and alternate transportation) that are incurred due to such cancellation are solely the guest's responsibility. We recommend Travel Insurance as a means of covering such an instance.
Refunds:- All payments for transportation, or travel service, not provided to the passenger shall be promptly refunded, in accordance with the agreed-to terms and conditions, unless the passenger otherwise instructs us in writing.
If you cancel your tour, or do not make payments as per the agreed upon schedule, we shall process your refund (after deducting the agreed uponcancellation costs) in less than thirty days from the earliest of the following dates:
(a) The scheduled date of departure.
(b) The day the passenger requests a refund.
(c) The day of cancellation by us.
In the unlikely event that we are unable to provide the tour package, we will process the refund of all your payments within three days from the day that we become aware of this inability.
In the event of cancellation due to unforeseeable circumstances beyond our control (such as a natural disaster), we will refund all your money, less anyNon-Refundable Charges, within 30 days of cancellation, after adjusting for any unrecoverable payments already tendered to our suppliers as per policy stated in the following paragraph: -
Release of liability:- Besides looking after your comfort and enjoyment, we do our best to ensure that you travel, explore, and reside in a safe and risk free environment. However, we are not responsible, in any sense of the term, for the safety, health, and/or condition, of any guest’s person, their wards, or their property. Your acceptance of our "Confirmation of Tour Package" is also your legal, binding, & unconditional acceptance of the preceding statement.
You, and each party traveling in your tour expressly acknowledge that you are cognizant of all risks of travel and arrangements for trips of this nature and fully disclaim, waive and discharge Taj Mahal India Tours & Travels (including its shareholders, management, directors, and employees) from any and all liability, claims. damages, loss, or responsibilities (including damage to or loss of your property, or your injury or death) with regard to the proposed tour and/or visit, and arrangements made with respect thereto, even if caused by the negligence of any airlines, transportation companies, hotels, restaurants, or any other party providing services or accommodations included in the tour/visit.
We will similarly not be liable for any claims, losses, damages for delayed or lost baggage or other property, or any loss of intangibles such as pleasure, or feelings of disappointment, distress, or frustration, whether mental or physical, which may have resulted from any act or omission of any other party providing services to you during your tour/visit.
Financial Liability:Taj Mahal India Tours & Travels liability in any and all cases will be limited to a refund of the payments made directly by you to us,subject to our cancellation and refund policies. Your acceptance of our "Confirmation of Tour Package" is also your legal, binding, and unconditional acceptance of the preceding statement.
Disputes & Claims:By accepting the terms and conditions on this page you are agreeing to the following conditions for filing claims & disputes: All parties involved in this contract, agree that any dispute or difference arising out of or in connection with this contract shall be determined by the appointment by of a single arbitrator to be agreed between the parties, or failing agreement within fourteen days, after either party has given to the other a written request to concur in the appointment of an arbitrator, by an arbitrator to be appointed by the American Arbitration Association. All parties involved in this contract unconditionally agree to the following five provisions:
(a) The arbitration and resulting judgment will be final and binding and that all proceedings and judgments will be conducted under the jurisdiction of Texas State Law.
(b) The seat, or legal place, of arbitration shall be Austin, Texas
(c) The language to be used in the arbitral proceedings shall be English.
(d) The governing law of the contract shall be the substantive law of the State of Texas.
(e) The costs of Arbitration shall be equally shared by both parties involved in the dispute, unless one party introduces costs above and beyond what is normal in such a proceeding, in which case that party will be solely responsible for all such costs. What is normal will be determined by the Arbitrator reviewing the dispute. The arbitrator shall have the authority to only award compensatory damages.
This electronic contract has now been finalized and cannot be altered. The only dynamic section of this document (editable) is the payment section, which will be updated as Taj Mahal India Tours & Travels received payments from the guest. Any changes in the itinerary or condition will require the execution of a new electronic contract.
Flights Delays and Cancellations: We strongly recommend that you secure travel insurance for your time in India. If your international arrival is delayed, there are no last minute refunds for missed hotel nights. Guests that feel that they can pressure a hotelier into issuing a refund or credit for a missed night need to understand that the contract for their hotel reservations is between Taj Mahal India Tours & Travels and the Hotelier and we do not wish to harm our relationships with the Hoteliers. If you miss any domestic flights due to this delay, the Smart Fares we book are refundable with minimal cancellation charges but the new tickets that you will need to book are going to be significantly higher as they will be secured at the last minute. Although we use India’s best airlines and make every effort to use domestic flights that offer back-ups with later flights in case of a cancellation or significant delay, this is not always possible in every itinerary. If a domestic flight is cancelled and re-booking alternative flights (or using alternate means of transportation) is more or less expensive, a debit or credit will be issued to the guest. Hotel nights lost due to domestic travel cancellations have no last minute refunds for missed hotel nights.
We always recommend that you arrive at least a day before your tour begins, and leave at least a day after the tour ends. This protects you in case of flight delays and cancellations. By selecting the hotel stay before and after tour option on our inquiry form (or by talking to your India Specialist), we can get you our pre-negotiated rates on your choice of accommodation for those days.
Documentation: Visitors entering India and its neighbouring countries require visa which generally takes 06 to 08 weeks’ time. Visa charges are not a part of quoted tour costs.
It is strongly recommended to buy the appropriate travel insurance policy prior to commencement of your tour. If you need any help or guidance we will be happy to connect you with travel insurers.
All documents related to your travel such as booking details of your hotels & domestic travel documents will be available with our staff at your station of arrival. He will brief you once you reach that Station and then hand it over to you.
